In NY, is an "open alcohol" or open container violation a misdemeanor? Do I need to declare it on a job app?

I received a pink ticket for "open alcohol" (as it says), in violation of NY Law 10-125-(2)(b). It was for drinking alcohol on the subway. Is this crime a misdemeanor? What class? If not, do I have to declare it on a job application that asks "have you ever been convicted of any crime or felony?"

I'm not sure about NY, but in NJ it's just like a parking ticket. No points, and no time in jail. You will have to go to court and pay a fine. You may even be able to have the fine reduced.



It's not a felony, and not considered a crime. But you did break a law. You can call any precinct and ask, they can tell you for peace of mind. Just make sure you show up for court, or a warrant may be issued.

They gonna think you are an alcoholic....

It's a summary offense. You don't have a criminal record. It's like getting a parking ticket.
