Can a company tell you they won't hire you because you have Acne?

My 19 year old daughter has been looking for a part time job for a while now. She filled out an application for Subway and was called for an interview. She interviewed with the owner who told her that her application and qualifications looked great and there is no reason for him not to hire her. He then said the only problem I have is with your skin and your acne. If I did hire you you would need to wear more makeup to cover it up. I can't believe he said that! I heard this and became furious! Obliviously my daughter left there crying. I don't think what he is doing is legal. I think it's discrimination and i don't know what to do.Can a company tell you they won't hire you because you have Acne?
It's insensitive and stupid; and probably legal. There is no EEOC protection against discrimination based on appearance.

I have kids who were teenagers at one time. They lie A LOT. Trust me, do some serious investigating before you embarrass yourself. Tell the kid they tape the interview, and when you called to confront them, they wanted you to come in and meet with them, watching the interview. i afraid it's possibly happen..they are choosy and just hire a good-looking employee to attract customer..yeah it's discrimination but i'm not sure it's illegal or not..sorry
Yes, it is discrimination. However, it is not illegal discrimination. Employers can and do discriminate over tattoos, piercings, unnatural hair color, fingernails, hair style, and a host of other things that are not "protected class". You daughter probably does need to do what she can to minimize acne for her job search, because that matters in lots of places. It's not fair. It's not nice. And what he said was probably not tactful or particularly kind, either. However, it makes a difference, particularly in the food industry.

Instead of bothering with an expensive lawsuit, why not help her find a good dermotologist instead? She's suffering needlessly. Lack of attention to such an easily correctable problem suggests lax hygeine, which is a red flag in the restaurant business. And employers are, in fact, entitled to prefer one applicant over another. There are always other reasons employer might assert if you attempt to press your claim. What's the point?
If it's that awful do you think people want her to make their sandwiches? Employers can not hire for any reason except protected classes. Acne infested teenagers aren't protected.
No, they can't reject your daughter based on appearance. You should file a law suit against the company. They will probably try to settle it out of court and you will become a rich person.
I don't think they can do that. You might want to check with labor commission in your state.

I do believe it is discrimination.
Hire an attorney and sue them.
